'Leaked.' I'm sure to try to create a rage filled mob to inspire Roberts to cower and retreat. But they can do it without him, and if he goes against it when there is no hope for bringing it down, he may not recover from that, either. but, as with the election, he was able to smother even the majority. So, we'll see.

My gut says that Kagan herself leaked it.

Some rumors suggest Roberts was already waffling before the leak, and trying to find a “middle ground” like he did with Obamacare. He hated Trump for rightly calling out too many judges as political agents. Where’s his veneer of apolitical attitude now?

Regardless, Roberts smothered issues with the election by having the court not take the issue up. There’s no hope of that in this case, and some have speculated he’ll side with conservatives if only to write a standing opinion that isn’t as full-throated as the leaked draft in the hope that gives the left some appeasement (News Flash: It won’t).

We’ll see.

As for this impacting the election. Yeah, this will likely be the thing Democrats run on, because it’s the only thing they can. It will likely fire up their base, but it’s up in the air whether moderates and independents will be moved, especially as cries of “court packing” have already started up again. And I’d call on every Republican challenger to confront their claims of up holding ‘women’s rights,’ by asking the simple question “What is a woman?”
